| Fall Newsletter 2009 Presidents Message Wow what a turn out in Lexington! I saw a lot of old friends and made some new ones. Wade and I were so busy at the convention; we didn't get to participate in either of the Judges seminars. I would like to give special Thanks to Wade Calvert and Damon Kustes, without these two individuals the show could not have been what it was. The convention was the biggest and best that I have seen it in the last six years. We were missing some of our regulars at the show. Those of you that could not attend, you were missed greatly! This was absolutely the best Convention I have been a part of since I have been attending. Just email you’re listing and/or picture to ktaxidermy101@yahoo.com and it will be posted ASAP. ______________________________________________________________________________________________________________________________________ ___ New Bio-Security Regulations Adopted for Taxidermists in Michigan April 3, 2009 In the wake of chronic wasting disease (CWD), the Natural Resources Commission has approved new bio-security regulations for Michigan taxidermists. There is evidence from other states to suggest that carcasses from CWD-infected animals have led to new CWD infections. A case of CWD in New York was linked to a business that had both captive cervids and taxidermy operations. The new regulations prohibit taxidermists with captive cervids on their premises from allowing live animals to have contact with any taxidermy materials or waste. All animal waste must be disposed of in a type II landfill, which accepts general household waste. And taxidermists may not provide any parts of deer, elk, or moose to be used for the purposes of attracting animals for hunting, trapping, or other recreational pursuits. The new regulations include increased fees and reporting requirements. It is already illegal for hunters to bring into Michigan any parts of deer, elk or moose other than boned meat, antlers, hides, and cleaned skull caps from animals taken in any state or province where CWD is known to exist. It is illegal to possess such a carcass that has been illegally imported into Michigan. It is also illegal to possess a carcass from the CWD surveillance zone in Kent County, unless it has tested negative for CWD. Did You Know as a Taxidermist you are required to pay “USE TAX” to the state Of Kentucky on you’re out of state purchases. (McKenzie, Van Dyke’s etc). In Kentucky, A Taxidermist is considered a consumer not a retailer. You are not subject to collecting Sales tax on your mounts unless you sell extra’s that are not normally included in the Mounts pricing. (Ie: extra cost for a panel, Trophy plate, replicas etc). If you would like to donate a carcass, please write the confirmation number, county, specific location (GPS location, creek name, road name, intersection, etc.), date the animal was trapped, hunted, or road-killed and collector name, address, and phone number on a piece of paper. Enclose the paper in a zip-loc bag and attach it to the carcass. CONCEALED CARRY KRS 237.110 authorizes hunters with valid concealed carry deadly weapon permits to carry firearms during archery-only or archery/crossbow seasons and to carry firearms and ammunition that may be contrary to hunting equipment caliber or ammunition requirements. However, hunters shall not take game with firearms during seasons when firearms are prohibited, or with any equipment listed as illegal for taking game ______________________________________________________________________________________________________________________________________ _ Record number apply for Kentucky elk drawing A record 35,390 applicants have paid a non-refundable $10 each for the chance to acquire one of 1,007 quota elk hunt tags being issued this year by the Kentucky Department of Fish and Wildlife Resources. Colorado taxidermist sentenced for doing poacher's mounts A Cortez, Colo. man was sentenced in US District Court yesterday to 3 years probation and 50 hours of community service for doing taxidermy work for a convicted poacher. Taxidermist Paul Weyand pleaded guilty in March to three misdemeanor counts of illegally labeling and transporting wildlife--two black bears and a mule deer buck. Weyland was also fined $2,000 ______________________________________________________________________________________________________________________________________ _ Final Tenn. elk tag sells for $17,700 on eBay The last of five permits for the first Tennessee elk hunt in modern times was acquired by Franklin, Tenn. businessman Andy Miller, with his high bid of $17,700 on the online commerce site, eBay. Hunter sues over trophy mount GREG TUTTLE Of The Gazette Staff | Posted: Friday, March 27, 2009 A Billings hunter wants a taxidermist either to pay him to hunt mountain goat in Canada or reimburse his expenses for a successful Montana goat hunt. The hunter, Michael Sartorie, took his case against All Mount Taxidermy Inc. to a District Court judge on Friday after recently rejecting an offer for a finished replacement mount. Judge Gregory Todd listened to testimony from Sartorie and All Mount owner Brad Johnson for just over an hour at a nonjury trial. Todd said he would issue a decision later. Sartorie sued All Mount, alleging that the business botched his trophy goat mount. The lawsuit claims All Mount should either pay for Sartorie to hunt another goat in Canada or reimburse him the $4,275 he spent on the Montana hunt. Johnson told the judge that he sent Sartorie's goat hide to a tanning company in Texas, shortly after he bought the business from Wayne Olivo in January 2006. The Texas company, Quality Fur Dressing, either lost or destroyed the hide, Johnson said. Johnson tried to make good with Sartorie by creating a full-body goat mount, as Sartorie originally ordered, using the horns from Sartorie's goat and the hide of a different goat. Sartorie rejected the offer, saying he wanted a trophy mount of a goat he shot, not another goat, and mounted by a taxidermist of his choice. Sartorie gave Olivo an $800 down payment for the goat mount, and he had no idea that Olivo sold the business until a year later when he called All Mount to check on the goat. Sartorie said he applied unsuccessfully for 35 years for a Montana goat tag before winning the limited draw tag in 2005.He spent more than $4,000 on a successful hunt near Gardiner. Sartorie also told the judge that he designed a special place in the living room of the house he was building at the time to display the goat mount. Sartorie's attorney, George Radovich, said the only way to compensate his client fully was to order the taxidermist to pay the cost for Sartorie to hunt a mountain goat in Canada, where such tags are much easier to get than in Montana. Sartorie said he researched goat hunts in Canada and determined that the cost would be $8,000 to $10,000.As an alternative, All Mount should be ordered to reimburse Sartorie for the cost of his Montana hunt, Radovich said. Johnson's attorney, Jock West, asked Sartorie if he benefited from the experience of the Montana goat hunt.West said the judge should consider limiting any damages against All Mount. The case presents some challenging issues for both sides, the judge said .Court rules may prevent him from weighing the fact that Johnson offered to replace Sartorie's goat mount, Todd said. The judge also said he cannot make a ruling against the Texas tanning company because it is not named in the lawsuit and he has no jurisdiction to order it to pay any damages ."It looks like we've got somebody down in Texas who is the real culprit here who screwed things up," Todd said. By a 63-35 vote, cloture was invoked and debate stopped on the nomination of Cass Sunstein to serve as the head of the Office of Information and Regulatory Affairs (OIRA). Of the 63 senators that voted in favor of Sunstein, an anti-hunter, 22 were members of the Congressional Sportsmen’s Caucus, or 42 percent. The vote was held despite the efforts of Senator Johnny Isakson (R- GA) to place a “hold” on the nomination of Sunstein. The U.S. Sportsmen’s Alliance (USSA) and the National Wild Turkey Federation (NWTF) made this confirmation fight a top priority. These efforts were also aided by many conservation groups from around the nation such as: National Shooting Sports Foundation, Masters of Foxhounds Association of North America, Fur Takers of America, National Trappers’ Association, Conservation Force, Shikar Safari Club, Mule Deer Foundation, Delta Water Fowl Foundation, Pope and Young Club, Dallas Safari Club, Whitetails Unlimited, Inc., Houston Safari Club, Texas Wildlife Association, and the Wild Sheep Foundation. The efforts of those groups and many others were instrumental in persuading Sen. Isakson to attempt placing a “hold” on Sunstein. “We are disappointed with the outcome of tonight’s vote, especially that so many members of the Senate claiming to be pro-sportsman voted in favor of a nominee who has expressed that recreational hunting could be banned,” stated USSA President and CEO Bud Pidgeon. “Nonetheless, the USSA and our partners had an obligation to fight this appointment. Sportsmen all across America will clearly be able to see which senators, along with Sen. Isakson, were willing to stand up for them.” The USSA and others argued for weeks that Sunstein’s views on giving animals standing in court and banning recreational hunting would pose an intolerable threat to sportsmen given the critical position the OIRA has in the implementation of all federal rules.
